THAT Application A20/2023P for relief of Section 3.28.1(a)(i) “Urban Area – Maximum Floor Area” – to permit a maximum floor area of 92.5 m2 for a second dwelling unit whereas the by-law permits a maximum floor area of 75 m2 for a second dwelling unit, is hereby: GRANTED The above decision is based on the following reasons: 1. The variance is minor in nature as the area of the basement is existing and is not proposed to be enlarged. The second dwelling unit will remain secondary to the principal dwelling unit on the upper level in terms of floor area. Further, the increase in the floor area will not have any impact on the dwelling as viewed from the street. 2. The general purpose and intent of the Zoning By-Law is maintained. 3. The intent of the Official Plan is maintained. 4. The proposal is desirable for the appropriate development and/or use of the land because the proposal will contribute to providing a more affordable housing rental opportunity for future residents. Further, the conversion of the basement to a second dwelling unit will provide a rental income opportunity for the owner of the dwelling. 5. This application is granted without prejudice to any other application in the Town of Pelham. 6. The Committee of Adjustment considered the written and oral comments and agrees with the minor variance report analysis and recommendation that this application meets the Planning Act tests for minor variance.
